Terms of Service
Dirty Bourbon Dance Hall and Saloon, LLC
These Terms of Service ("Terms") form a binding agreement between you ("you", "user", or "guest") and Dirty Bourbon Dance Hall and Saloon, LLC ("Dirty Bourbon", "we", "us", or "our") governing your use of our website, mobile application, memberships, reservations, events, promotions, and on-premises services (collectively, the "Services"). Please read them carefully.
1. Acceptance of Terms
By creating an account, downloading or installing our mobile application, accessing our website, purchasing a membership, reserving a VIP section, redeeming a guest pass, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.
2. Eligibility & Age Requirement
You must be at least 21 years of age to purchase, hold, or use any membership, VIP reservation, guest pass, promotion, or other benefit that relates to alcohol or to entry into a venue that serves alcohol. Government-issued photo ID is required at the door. We may refuse entry, suspend, or terminate any account that appears to violate this requirement.
3. Accounts & Security
You are responsible for the accuracy of the information you provide and for all activity under your account, including any QR pass, membership credential, or reservation code associated with it. Do not share your login credentials or your QR pass with anyone else. Notify us promptly if you suspect unauthorized use.
4. Memberships
- Membership tiers, benefits, pricing, and perks may change at any time at our discretion.
- Memberships are personal, non-transferable, and subject to venue policies and capacity.
- Membership benefits — including discounted or complimentary cover, loyalty rewards, and access to promotions — do not constitute a guarantee of entry or service on any particular date.
- Abuse of membership benefits, fraudulent activity, sharing of credentials, or conduct that violates venue policies may result in suspension or termination without refund.
5. VIP Reservations
- VIP reservations are subject to availability and to the venue's published operating days. Reservations are not available on dates the venue is closed.
- The reservation fee reserves the section only. It does not include cover charges, beverages, food, gratuity, or any other in-venue purchase.
- All reservations must be claimed by 10:00 PM on the reservation date. Unclaimed reservations may be released without refund.
- No-shows are non-refundable. All reservation sales are final unless otherwise required by applicable law.
- Special events may be added to the calendar after a reservation is made. In those cases, the affected reservation fee will be refunded in accordance with our then-current refund process.
- Conflict rules: reserving any Half Bullpen VIP section makes the Full Bullpen VIP unavailable for that date, and vice versa.
6. Guest Passes
- Guest passes are non-transferable unless we expressly state otherwise in writing.
- Guest passes are subject to venue approval, capacity, and the door staff's discretion.
- Guest passes may be limited per calendar month and excluded on certain ticketed or special events.
7. Events & Promotions
- Event schedules, lineups, performers, set times, and ticket availability may change without notice.
- Events may be postponed or cancelled. Refunds for ticketed events are governed by the ticketing provider's policies.
- We are not responsible for the acts, omissions, or programming of third-party performers, promoters, vendors, or ticketing providers.
8. Mobile Application Usage
- The mobile application is provided "as is" and you use it at your own risk.
- We do not guarantee uninterrupted, error-free, or secure access to the Services.
- Features may be added, modified, or removed at any time. Some features require an active internet connection, location services, push notifications, or device permissions to function.
- You are responsible for maintaining a compatible device, operating system, and current version of the app.
9. Purchases, Subscriptions & Refunds
- In-app purchases (including memberships, Skip-the-Line passes, and VIP reservations) are processed through Apple, Google, or another approved payment processor. Their terms and refund policies apply alongside ours.
- Subscriptions auto-renew at the then-current price until cancelled in the relevant app store.
- Except as required by law or expressly stated in these Terms, all sales are final and non-refundable.
10. User Conduct & Venue Policies
When attending the venue, you agree to comply with all posted venue policies, dress codes, ID requirements, and lawful instructions of our staff and security personnel. We reserve the right to refuse entry or remove any guest who is intoxicated, disruptive, or in possession of outside alcohol, weapons, or prohibited items, and to deny entry to anyone attempting to bring alcohol into or near the venue. No refunds will be issued in any such case.
11. Disclaimer & Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
Dirty Bourbon Dance Hall and Saloon, LLC, together with its owners, officers, directors, employees, contractors, affiliates, agents, and licensors (collectively, the "Released Parties"), shall not be liable for, and you waive any claim arising out of or related to:
- the conduct of any user, guest, performer, or third party;
- your decisions regarding the consumption of alcohol or any other substance;
- driving, riding, walking, or any other transportation decision made before, during, or after a visit;
- any injury, illness, loss, theft, or property damage arising on or off the premises;
- the acts or omissions of third-party vendors, performers, ticketing providers, or rideshare services;
- service interruptions, software defects, data loss, or unauthorized access to your account.
You assume full responsibility for your own choices, conduct, and well-being. To the maximum extent permitted by law, the Released Parties' aggregate liability for any claim relating to the Services shall not exceed the greater of (a) the amount you paid to us in the twelve (12) months preceding the claim, or (b) US $100.
12. Responsible Alcohol Consumption
Please drink responsibly. Never drink and drive. Use a rideshare service, designated driver, taxi, or other safe transportation home. Know your limits. If you or someone you are with needs assistance, please tell our staff.
13. Hold Harmless & Indemnification
You agree to indemnify, defend, and hold harmless Dirty Bourbon Dance Hall and Saloon, LLC and the Released Parties from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Services or attendance at the venue; (b) your membership, reservations, guest passes, or event participation; (c) your consumption of alcohol or other substances; (d) your violation of these Terms or any applicable law; or (e) your violation of any third-party right.
14. Privacy
Our collection and use of personal information is described in our Privacy Policy, which is incorporated by reference. By using the Services, you consent to that collection and use.
15. Intellectual Property
All trademarks, logos, content, designs, and software associated with the Services are owned by or licensed to Dirty Bourbon Dance Hall and Saloon, LLC. You may not copy, modify, distribute, or create derivative works without our prior written consent.
16. Changes to These Terms
We may update these Terms from time to time. The "Version" and "Effective" date at the top of this page reflect the current version. Material changes will be communicated in-app and require renewed acceptance before continued use of the Services.
17. Termination
We may suspend or terminate your account or access to the Services at any time, with or without notice, for any conduct that we believe violates these Terms, venue policies, or applicable law, or that is otherwise harmful to other users, our staff, or our business.
18. Governing Law & Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of those courts.
